Overview

Welcome to Sustainfind. The terms “we”, “us” and “our” refer to Sustainfind. Sustainfind operates sustainfind.co.uk, including all related information, content, features, and tools (the “Services”), as a platform connecting consumers with independent food and drink producers across the United Kingdom.

Sustainfind is a discovery and directory platform. We do not sell food or drink products, process consumer transactions, or handle deliveries. When you find a producer through Sustainfind and click through to their website, any purchases you make are between you and that producer.

Sustainfind is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with our Privacy Policy, describe your rights and responsibilities when you use the Services. Please read them carefully, as they include important information about your legal rights.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you should not use or access our Services.

1. Access and Accounts

1.1 Consumer access

You may browse Sustainfind freely without creating an account. Certain features, such as personalised distance calculations, require you to enter a postcode, which is stored locally on your device.

By using the Services, you represent that you are at least 16 years of age. If you are under 18, you should use the Services only with the involvement of a parent or guardian.

1.2 Producer accounts

Producers may create accounts to manage their listings on Sustainfind. By creating a producer account, you represent that you are authorised to act on behalf of the business you are listing, and that all information you provide is accurate and complete.

You are solely responsible for maintaining the security of your account credentials, including any email-based verification codes. You may not transfer, sell, assign, or license your account to any other person.

We reserve the right to suspend or terminate any producer account at our discretion, including where we reasonably believe the account holder is not the genuine owner or authorised representative of the listed business.

2. The Platform

2.1 What Sustainfind does

Sustainfind is a directory and discovery platform. We list independent food and drink producers, display their locations on an interactive map, calculate food miles distances, and provide environmental education content. We connect consumers with producers but do not participate in any transactions between them.

2.2 Accuracy of information

Producer listings on Sustainfind include information provided by producers themselves (for claimed listings) or compiled by the Sustainfind team from publicly available sources (for unclaimed listings). We make reasonable efforts to ensure accuracy but do not warrant that all information is complete, current, or error-free.

Food miles figures displayed on the platform are approximate calculations based on publicly available trade data from sources including DEFRA, HMRC, and AHDB. They are presented as general indicators of supply chain distance, not precise measurements. Our methodology is explained on our How We Calculate Food Miles page.

2.3 External links and purchases

When you click through from Sustainfind to a producer’s own website, you leave our platform. Any purchases, transactions, or interactions you have with a producer are governed by that producer’s own terms and conditions, privacy policy, and applicable law. Sustainfind is not a party to any transaction between you and a producer and accepts no liability for any products, services, or experiences provided by producers.

3. Producer Subscriptions

3.1 Subscription tiers

Sustainfind offers a free listing tier and paid subscription tiers for producers. Details of what each tier includes are published on our pricing page and may be updated from time to time. We will notify existing subscribers of material changes to their tier’s features.

3.2 Billing and payment

Paid subscriptions are billed monthly or annually, as selected by the producer at signup. All payments are processed by Stripe. Sustainfind does not collect or store payment card details.

Subscription fees are charged in advance for the billing period. By subscribing to a paid tier, you authorise Stripe to charge your chosen payment method on a recurring basis until you cancel.

Prices are stated in pounds sterling (GBP) and are inclusive of VAT where applicable. We reserve the right to change subscription prices on reasonable notice. Price changes will take effect at the start of your next billing period after notice is given.

3.3 Cancellation and downgrades

You may cancel your paid subscription or downgrade to a lower tier at any time through your producer dashboard or by contacting us. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial billing periods.

Upon cancellation of a paid subscription, your listing will revert to the free tier. Features associated with your paid tier (such as your full profile page, analytics, and featured placement) will no longer be available, though your basic map listing will remain.

3.4 Free listings

Free listings provide a basic map presence with the producer’s name, location, and category. Free listings may be created by the Sustainfind team using publicly available information or by producers themselves. We reserve the right to remove or modify free listings at our discretion.

4. Claiming a Listing

Producers whose businesses have been listed by the Sustainfind team may claim ownership of their listing through our claim process. Claiming requires email verification and is subject to manual review by the Sustainfind team.

We reserve the right to decline a claim if we are not satisfied that the claimant is the genuine owner or authorised representative of the listed business. In the event of a dispute over listing ownership, our decision is final.

Claiming a listing does not create any obligation to subscribe to a paid tier. Producers may claim their listing and remain on the free tier.

5. Producer Content and Responsibilities

5.1 Content you provide

Producers are responsible for the accuracy and legality of all content they upload or provide to Sustainfind, including business descriptions, images, sustainability claims, contact information, and any other profile content.

By uploading content to Sustainfind, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and distribute that content on the platform and in related marketing materials for the purpose of operating and promoting Sustainfind. This licence continues for as long as the content remains on the platform and for a reasonable period after removal to allow for cached or archived copies to expire.

5.2 Sustainability claims

Producers must only claim sustainability credentials (such as Organic, Free Range, Soil Association certification, etc.) that they genuinely hold. Sustainfind displays these credentials based on information provided by the producer. We do not independently audit or verify sustainability claims at this stage.

If we receive a credible report that a sustainability claim is inaccurate or misleading, we may remove the relevant credential from the listing and contact the producer for clarification. Repeated or deliberate misrepresentation of sustainability credentials may result in listing removal.

5.3 Prohibited content

You may not upload or publish content that is unlawful, defamatory, misleading, infringing of third-party intellectual property rights, or otherwise objectionable. We reserve the right to remove any content that violates these Terms or that we consider inappropriate, without prior notice.

6. Intellectual Property

The Services, including all trademarks, text, images, graphics, design, and arrangement thereof, are owned by Sustainfind or its licensors and are protected by UK and international intellectual property laws.

You may access and use the Services for personal, non-commercial use only. You must not reproduce, distribute, modify, or create derivative works from any material on the Services without our prior written consent.

Sustainfind’s name, logo, tagline, and visual identity are our trademarks. You must not use them without our prior written permission. Shopify’s name and logo are trademarks of Shopify Inc.

7. Third-Party Services and Links

The Services incorporate or link to services provided by third parties, including Shopify (platform hosting), Stripe (payment processing), Mapbox (mapping), Postcodes.io (postcode lookup), and Resend (email delivery). Your use of these services is subject to their respective terms and privacy policies.

We are not responsible for the content, accuracy, or practices of any third-party websites or services, including producer websites that you may access via links on Sustainfind.

8. Relationship with Shopify

Sustainfind is powered by Shopify, which enables us to provide the Services to you. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of the Services or for any interactions between you and Sustainfind or between you and any producer listed on the platform. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your use of the Services.

9. Privacy

All personal information we collect through the Services is subject to our Privacy Policy. By using the Services, you acknowledge that you have read and understood our Privacy Policy.

Because the Services are hosted by Shopify, Shopify collects and processes certain personal information about your access to and use of the Services. Review our Privacy Policy and Shopify’s Consumer Privacy Policy for further details.

10. Feedback and Reviews

If you submit any ideas, suggestions, feedback, or other content to us, you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute, and display such content for any purpose related to the operation and promotion of Sustainfind.

You represent that you own or have all necessary rights to any content you submit, and that it does not violate any third-party rights or applicable law. We may remove any submitted content at our discretion without notice.

11. Prohibited Uses

You may access and use the Services for lawful purposes only. You may not: (a) use the Services for any unlawful or malicious purpose; (b) violate any applicable law or regulation; (c) infringe upon the intellectual property rights of Sustainfind, its producers, or any third party; (d) harass, abuse, or harm any person; (e) transmit false or misleading information; (f) upload viruses or other malicious code; (g) send unsolicited commercial communications; (h) impersonate any person or entity; (i) scrape, crawl, or use automated tools to extract data from the Services without our consent; or (j) interfere with or circumvent any security features of the Services.

We reserve the right to suspend or terminate your access to the Services at any time if we determine that you have violated these Terms.

12. Automated Agents

This section applies if you use or deploy any software or service that takes autonomous or semi-autonomous action to access or interact with the Services (“Agent”).

No Agent may access or interact with the Services unless it identifies itself as an Agent in all HTTP requests, operates in accordance with our published guidelines, and does not conceal or obfuscate its automated nature. Agents must not circumvent CAPTCHAs or other measures intended to distinguish computer use from human use.

We may limit or block Agent access to the Services at our discretion.

13. Disclaimer of Warranties

The information presented on or through the Services is made available for general information purposes. We do not warrant the accuracy, completeness, or usefulness of this information. Any reliance you place on it is at your own risk.

The Services are provided “as is” and “as available” without any representations, warranties, or conditions of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be uninterrupted, timely, secure, or error-free.

Food miles data, supermarket benchmarks, and environmental comparisons presented on the platform are approximate and based on publicly available data. They should not be treated as precise environmental assessments. We do not warrant the accuracy of any environmental or sustainability claims made by listed producers.

14. Limitation of Liability

To the fullest extent permitted by law, Sustainfind, its directors, officers, employees, affiliates, agents, and service providers, and Shopify and its affiliates, shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the Services, any content on the Services, or any interactions with producers found through the Services.

Our total aggregate liability to you for all claims arising from or related to the Services shall not exceed the amount you have paid to Sustainfind (if any) in the twelve months preceding the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

15. Indemnification

You agree to indemnify, defend, and hold harmless Sustainfind, Shopify, and our respective affiliates, officers, directors, employees, and agents from any losses, damages, liabilities, or claims (including reasonable legal fees) arising from: (a) your breach of these Terms; (b) your violation of any law or the rights of a third party; or (c) your access to and use of the Services.

16. Termination

We may terminate or suspend your access to the Services at any time, without prior notice, for any reason, including if we believe you have violated these Terms.

Producers on paid subscriptions who have their accounts terminated by us for breach of these Terms will not be entitled to a refund for any remaining subscription period.

Sections relating to intellectual property, feedback, disclaimers, limitation of liability, indemnification, and governing law shall survive any termination of these Terms.

17. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be enforced to the fullest extent permitted by law, and the remaining provisions shall continue in full force and effect.

18. Waiver and Entire Agreement

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sustainfind regarding the Services and supersede any prior agreements or understandings.

19. Assignment

You may not transfer or assign these Terms or any of your rights or obligations without our prior written consent. We may transfer, assign, or delegate these Terms without restriction.

20. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

21. Changes to These Terms

We reserve the right to update or modify these Terms at any time. We will post the revised Terms on this page and update the “Last updated” date. Material changes will be notified in accordance with applicable law. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
